These terms apply to everyone who uses homecuisinemarkets.com (“Home Cuisine Market”, “we”, “us”). By using the site you agree to them. Home cooks who list a kitchen also agree to the Cook Terms below.
1. What Home Cuisine Market is
Home Cuisine Market is a directory. It helps you find independent home cooks and contact them on WhatsApp. We don't cook, sell, handle, deliver or inspect any food, and we don't take orders or payments for food. Each order is an arrangement directly between you and the cook, and we are not a party to it.
2. Cooks are independent
Cooks are not our employees, agents or partners. Each cook is solely responsible for their food, how it is prepared, stored, packaged and delivered, its safety, and for following the laws and public health rules that apply to them.
3. Listings, menus, photos and labels
Everything on a cook's page (menus, dish descriptions, prices, photos, diet marks such as veg, vegan, egg or non-veg, allergen information, kitchen tags such as halal or Jain, availability and order deadlines) is provided by the cook. We don't verify it and can't guarantee it is accurate, complete or up to date. Photos may not show the exact food you receive.
A “Food handler certified” badge only means the cook uploaded a food handler certificate that we looked at. It is not an inspection of their kitchen or food, and it is not a guarantee of food safety.
4. Allergies, diet and health
- Allergen and diet information comes from the cook. Home kitchens often handle many ingredients, so there is a risk of cross-contact with allergens that aren't listed.
- If you have a food allergy, intolerance, dietary or religious requirement, or a health condition, confirm the ingredients and preparation directly with the cook before ordering, and decide for yourself whether the food is right for you.
- You eat food ordered through cooks listed here at your own risk. If you have a reaction or feel unwell, seek medical help right away.
- Nothing on this site is medical, nutritional or dietary advice.
5. Orders, payment, delivery and disputes
Prices, payment, pickup, delivery, cancellations and refunds are agreed between you and the cook. Any problem with an order, including quality, quantity, lateness, a no-show or a payment dispute, must be resolved with the cook. WhatsApp is a separate service run by Meta under its own terms.
6. Reviews
Reviews are the opinions of the people who wrote them, not ours. Reviews must be honest, based on your own experience, and must not be abusive, discriminatory, or contain personal information. We may moderate, hide or remove reviews at our discretion.
7. Using the site
Don't misuse the site: no false information, impersonation, spam, scraping, or attempts to break or overload it. We may suspend or remove any account, listing or review that breaks these terms.
8. No warranties
The site and all listings are provided “as is” and “as available”. To the extent the law allows, we make no promises about the cooks, their food, or the accuracy, availability or reliability of the site.
9. Limitation of liability
To the fullest extent permitted by law, Home Cuisine Market and its owners, staff and partners are not liable for any loss, injury, illness, allergic reaction or other harm, or any dispute, arising from food ordered from or arranged with a cook, from any cook listing (including inaccurate menus, photos, prices, diet or allergen information), from reviews, or from your use of the site. Our total liability for any claim relating to the site is limited to CAD $100.
Nothing in these terms limits any rights you have under consumer protection law that can't be excluded, or our liability where the law doesn't allow it to be limited.
10. Changes and governing law
We may update these terms; the date at the top shows the latest version, and continuing to use the site means you accept the update. These terms are governed by the laws of Ontario and the federal laws of Canada that apply there.
Cook Terms
These terms apply in addition to the terms above to every cook who lists a kitchen. Cooks accept them when they create a listing, and again when they change.
- Your business. You run your own independent food business. You are solely responsible for your food and its safety, and for complying with every law, by-law and public health requirement that applies to you, including any registration, inspection, food handler training, licensing, zoning, labelling and tax obligations.
- Accurate listings. You are responsible for keeping your profile, menus, prices, photos, diet marks, kitchen tags and allergen information accurate and up to date. Only use photos you took or have the right to use, and that fairly represent your food.
- Allergens. List every priority allergen your dishes contain, tell customers about any cross-contact risk, and answer their allergen questions honestly.
- Your customers. Orders, payment, pickup, delivery, refunds and complaints are between you and your customers.
- Insurance. You are responsible for having any insurance you need. We recommend liability insurance for food businesses.
- Your content. You keep ownership of what you upload, and give us permission to display it on the site and in links to it (such as WhatsApp or search results) while your listing is active.
- Fees. Listing on Home Cuisine Market may become subject to a fee. We'll tell you the price and terms before any fee applies, and you can choose whether to continue.
- Review and removal. We review new listings and may decline, suspend or remove a listing, menu, photo or review at our discretion, including after complaints.
- Indemnity. You agree to compensate and protect Home Cuisine Market and its owners and staff against claims, losses and costs (including reasonable legal fees) arising from your food, your listing, your dealings with customers, or your breach of these terms or the law.
Delivery Partner Terms
These terms apply in addition to the terms above to everyone listed as a delivery partner. Partners accept them when they create a profile, and again when they change.
- You're independent. You run your own delivery service. You aren't employed by, and don't act for, Home Cuisine Market. We don't assign, schedule, price or pay for deliveries; you agree those directly with cooks and customers.
- Licence, vehicle and insurance. You're responsible for holding any licence your vehicle needs, keeping it roadworthy, following traffic laws, and having insurance that covers paid deliveries. Personal policies often don't.
- Food safety on the way. Keep food clean, sealed and at a safe temperature, using insulated bags where needed, and deliver promptly. Don't open or tamper with orders.
- Honest profile. Keep your details, areas, availability and rates accurate. The ID you upload must be yours and valid; our team uses it only to verify you.
- Respect and safety. Treat cooks and customers courteously, respect their privacy, and use their addresses and contact details only for the delivery.
- Review and removal. We review new profiles and may decline, suspend or remove a listing at our discretion, including after complaints.
- Indemnity. You agree to compensate and protect Home Cuisine Market and its owners and staff against claims, losses and costs (including reasonable legal fees) arising from your deliveries, your vehicle, your dealings with cooks and customers, or your breach of these terms or the law.
